Summary: By using LifePulse, you agree to these terms. The app is a safety tool, not a replacement for emergency services. Always call emergency services (911, 112, etc.) in life-threatening situations.
1. Acceptance of Terms
By downloading, installing, or using the LifePulse mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and LifePulse ("we," "us," or "our").
2. Description of Service
LifePulse is a personal safety application that:
- Allows you to set up daily check-in reminders
- Notifies designated emergency contacts via email and/or SMS if you fail to check in within a specified time period
- Optionally shares your last known location with emergency contacts in alerts
Important: This App is NOT a replacement for emergency services. In case of a medical emergency, crime, fire, or other life-threatening situation, always contact your local emergency services (911, 112, 999, etc.) immediately.
3. Eligibility
To use the App, you must:
- Be at least 13 years of age (or the minimum age in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable laws
If you are under 18, you must have your parent or guardian's permission to use the App.
4. Account Registration
To use the App, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly update any information that becomes inaccurate
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Emergency Contacts
By adding emergency contacts to the App, you represent and warrant that:
- You have obtained consent from each person to be listed as your emergency contact
- You have informed them about the nature of the alerts they may receive
- The contact information you provide is accurate
- You have the right to share their contact information with us for alert purposes
You are solely responsible for maintaining accurate and up-to-date emergency contact information.
6. Subscriptions and Payments
6.1 Free and Premium Plans
The App offers both free and premium subscription plans. Premium features include:
- SMS alerts (free plan includes email only)
- Up to 5 emergency contacts (free plan limited to 1)
- Priority support
6.2 Subscription Terms
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- Prices are in South African Rand (ZAR) unless otherwise stated
- We reserve the right to change subscription prices with notice
6.3 Cancellation and Refunds
- You can cancel your subscription at any time through your App Store or Google Play account settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial subscription periods
- Refund requests are handled according to App Store and Google Play policies
6.4 Free Trials
We may offer free trial periods for premium features. If you do not cancel before the trial ends, you will be automatically charged for a subscription.
7. User Responsibilities
You agree to:
- Use the App only for its intended purpose as a personal safety tool
- Check in regularly according to your configured schedule
- Keep your emergency contact information accurate and current
- Not rely solely on this App for emergency situations
- Inform your emergency contacts about false alarms if you miss a check-in unintentionally
8. Prohibited Uses
You agree NOT to:
- Use the App to harass, stalk, or harm others
- Add emergency contacts without their consent
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the App
- Use the App in any way that could damage, disable, or impair our services
- Intentionally send false alerts to your contacts
- Create multiple accounts to circumvent subscription limits
9. Service Availability
We strive to provide reliable service, but we do not guarantee:
- Uninterrupted or error-free operation of the App
- That alerts will always be delivered successfully
- That SMS or email delivery will be instantaneous
- Service availability during maintenance or technical issues
Alert delivery depends on third-party services (mobile networks, email providers) which are outside our control.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We specifically disclaim:
- Any warranty that the App will meet your specific requirements
- Any warranty that the App will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy or reliability of any information obtained through the App
- Any warranty that defects will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of profits, data, use, or other intangible losses
- We shall not be liable for any damages resulting from failed or delayed alert delivery
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
Some jurisdictions do not allow limitation of certain warranties or liabilities, so some of these limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless LifePulse and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you provide through the App
13. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of LifePulse and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
14. Termination
We may terminate or suspend your account immediately, without prior notice, if:
- You violate these Terms
- We are required to do so by law
- We discontinue the App or service
Upon termination:
- Your right to use the App ceases immediately
- We may delete your account and data (subject to our Privacy Policy)
- Provisions that by their nature should survive will remain in effect
You may terminate your account at any time by deleting your account through the App settings.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by:
- Posting the new Terms on this page
- Updating the "Last updated" date
- Sending you a notification in the App for material changes
Your continued use of the App after changes become effective constitutes acceptance of the new Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
Any disputes arising from these Terms shall be resolved in the courts of South Africa.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LifePulse regarding the App and supersede any prior agreements.
